University's NCAA appeal on hold awaiting hearing

TUSCALOOSA | Resolution to the University of Alabama’s appeal of NCAA sanctions in its textbook disbursement case is on hold until the NCAA schedules an administrative hearing on the matter.

UA has requested an administrative hearing with the NCAA Infractions Appeals Committee as part of the appeals process, but the meeting has not been held or scheduled, a UA official confirmed late Tuesday.

Alabama is appealing to restore 21 vacated football victories and results in other sports. The vacated victories were part of penalties levied by the NCAA’s Committee on Infractions for improper disbursement of textbooks and other academic materials to more than 200 student-athletes in multiple sports over several years. An internal UA investigation discovered the widespread pattern of disbursement of materials that student-athletes were not entitled to receive as part of their scholarships after five football players were suspended for four games each in the 2007 season. Most cases were inadvertent on the part of the student-athletes, but there were some cases of abuse of the system where student-athletes were obtaining textbooks for friends.

“The appeal we’ve filed is consistent with the feelings that we shared in ours statements following the original ruling,” UA Director of Athletics Mal Moore said in a statement following the announcement of UA’s appeal in July. “I think it reflects valid points we felt needed to be expanded upon, and I’m hopeful that the Committee will consider the appeal fairly and with care.”

The sanctions were announced on June 11, with Alabama filing its appeal on July 27. The Committee on Infractions responded to UA’s appeal and UA filed a rebuttal on Sept. 17.

The next step in the process is the administrative hearing. NCAA spokesperson Stacey Osburn told The Tuscaloosa News last week that, “as a rule of thumb, about a month after the (administrative) hearing, the Infractions Appeals Committee will deliberate in private and come to a final decision.”
